  2. These terms and conditions may be amended in whole or in part from time to time. Amendments will be effective immediately upon posting of the amended terms and conditions on this website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of the services represents your agreement to be bound by the terms and conditions as amended.

  3. www.sellmystuff.com.au is a place for sellers to advertise and promote items for sale. www.sellmystuff.com.au is not involved in the buying, selling, exchanging or dealing of any items listed therein.  The respective sellers of each item are solely responsible for descriptions, condition, authenticity, title, and all other matters relating to the items they list. www.sellmystuff.com.au makes no representations or warranties and there are no conditions of any kind, express or implied, statutory or otherwise, with respect to the goods and services offered on the site, including but not limited to:

    • implied warranties of merchantability, fitness for a particular purpose, title and non-infringement;

    • any implied warranty arising from course of dealing or usage of trade;

    • any obligation, liability, right, claim or remedy in tort, whether or not arising from the negligence of www.sellmystuff.com.au

  4. You are prohibited from using any method, mechanism, device or software to affect the proper functioning of www.sellmystuff.com.au. www.sellmystuff.com.au may, at its sole discretion and without notice, terminate the right of any subscriber to use the website.

  5. Buyers and sellers must be located in Australia. Sellers outside of these countries are not permitted to sell on www.sellmystuff.com.au. Sellers should not send items to an address that is outside Australia.

  6. You must not list anything that is illegal, offensive (including anything of a defamatory, pornographic, or racially or ethnically objectionable nature), stolen, or unsafe, anything which infringes copyright or other intellectual property rights, items which have been illegally imported or which would require illegal import or export in order to complete the transaction, or any item of which the sale is prohibited by, or violates any, law. Items that are on our Prohibited Items List are not permitted to be listed. You are responsible for ensuring that any listing by you does not breach this clause. You agree that www.sellmystuff.com.au may disclose your personal information, including your name and contact details, to the relevant authorities, parties and/or the applicable intellectual property right holders if we consider that you are in breach of this clause.

  7. All content on this website is the property of www.sellmystuff.com.au or the sellers. www.sellmystuff.com.au grants a limited license to each subscriber of the website to make personal use only of the website itself. Any other use, including reproduction, modification, distribution, transmission, or display of the content on the website is strictly prohibited.

  8. www.sellmystuff.com.au is governed by and construed in accordance with the laws of Australia. You agree to comply with all applicable laws, legislations and regulations regarding participation in, and the use of the website.

  9. www.sellmystuff.com.au is not responsible for any emails that are lost, misdirected, incomplete or illegible, or for failed, partial or garbled computer transmissions, or for technical failures of any kind including, but not limited to, malfunctioning of any network, hardware or software, which may limit a subscriber’s ability to use the website. Proof of sending will not be proof of receipt by www.sellmystuff.com.au. www.sellmystuff.com.au is not responsible for any online, telephone, or other charges you may incur in connection with subscribing to the website.

  10. www.sellmystuff.com.au will use every reasonable method to ensure the availability of the website, subject to any downtime for maintenance. However, www.sellmystuff.com.au takes no responsibility for any system unavailability or for any loss that is incurred as a result of the website being unavailable.

  11. It is the seller's and the buyer's responsibilities to ensure that any and all taxes that apply to the items or transactions are collected, reported and remitted to the Australian Tax Office.

  12. All delivery or pick-up arrangements must be made with the seller of the item. Delivery may incur additional charges above and beyond the total purchase price, to be negotiated separately between the buyer and seller.

  13. It is the seller's and the buyer's responsibility to obtain any applicable or necessary licenses, registrations, or any other form of approval for the items sold and to pay any fees associated therewith.

  14. You must register to buy and sell items on www.sellmystuff.com.au. Registration requires your full name, address, phone number and email address. This information will be used to contact you regarding your subscription.

  15. When listing items for sale, only your preferred method of contact will be displayed with your listing. Buyers will use this method to contact you regarding the item you have listed. All other information is kept confidential.

  16. Subscribers are also requested to provide information regarding their age and gender. This optional information is aggregated and used for statistical purposes only.

  17. All information collected is for the sole use of www.sellmystuff.com.au. This information will not be communicated to any other third parties without your written consent.
